Canadian employers can hire foreign workers if a Labour Market Impact Assessment (LMIA) proves that no Canadian citizen or permanent resident is available, willing, or qualified to take the job. To obtain an LMIA, the position must first be advertised for at least four weeks to give Canadian residents and permanent residents a fair chance to apply. Employers may proceed with hiring a foreign worker only if they can demonstrate that the applicants did not meet the required qualifications. Once approved, the foreign employee must apply for a Canadian work permit, supported by the LMIA, before beginning employment.
